Terms of Service

These Terms of Service (“Terms”) are a contract between VoxAide (“VoxAide”, “we”, “us”) and the organisation or person using our service (“you”, “Customer”). By creating an account or using VoxAide, you agree to these Terms. If you are agreeing on behalf of an organisation, you represent that you have authority to bind it.

1. The service

VoxAide provides AI-led phone screening and related voice software: it places consented, recorded phone calls, holds a structured conversation, and produces a transcript, score, summary, and recommendation, with optional integrations to your applicant-tracking system. We may update, improve, or change features over time.

2. Accounts & eligibility

You must provide accurate account information, keep your credentials secure, and are responsible for activity under your account. The service is for business use by people aged 18 or over.

3. Your responsibilities (important)

You are responsible for how you use VoxAide and for complying with the laws that apply to you, including:

  • Consent & recording laws. You must have a lawful basis to contact each person and to record the call. VoxAide discloses the AI and records consent at the start of every call; you are responsible for ensuring this meets the requirements of the jurisdictions you operate and call into.
  • Employment & anti-discrimination law. VoxAide’s scores and recommendations are advisory tools. A human must make every hiring decision. You are responsible for fair, lawful hiring practices, including any automated-employment-decision rules that apply to you (for example, NYC Local Law 144 / EEOC-style requirements).
  • Accurate data & permissions. You must have the right to upload or connect the candidate and job data you put into VoxAide, and to authorise the integrations you connect.
  • No prohibited use. Do not use VoxAide for unlawful, deceptive, harassing, or high-risk purposes, to spam or robocall in violation of law, to bypass the AI disclosure or consent step, or to attempt to break, overload, or reverse-engineer the service.

4. AI disclosure & consent

Every screening call begins by disclosing that the caller is an AI agent, identifying the organisation and purpose, and asking for consent to record. You must not disable, remove, or misrepresent this disclosure. If a person declines, the call ends without screening.

5. Fees & billing

Paid plans and usage-based credits are billed as described at sign-up or in your order. Fees are payable in advance and are non-refundable except where required by law. We may change pricing on renewal with notice. Failure to pay may result in suspension.

6. Data & privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. For business customers, a Data Processing Addendum is available on request. You retain ownership of your data; you grant us the rights needed to provide the service.

7. Third-party integrations

If you connect a third-party service (such as JobAdder), your use of that service is governed by its own terms, and you authorise VoxAide to access and exchange data with it on your behalf for the features you enable. We are not responsible for third-party services.

8. Intellectual property

VoxAide and its software, content, and trademarks are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the service under these Terms. You keep your own data and content.

9. Disclaimers

The service is provided “as is”. VoxAide produces AI-generated assessments that may contain errors and are advisory only; we do not warrant that they are accurate, complete, or suitable for a particular decision. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits rights that cannot be excluded under applicable consumer law.

10. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, and our total liability arising out of or relating to the service is limited to the fees you paid us in the 12 months before the event giving rise to the claim.

11. Indemnity

You will defend and indemnify VoxAide against third-party claims arising from your use of the service in breach of these Terms or applicable law, including claims relating to consent, recording, or hiring decisions you make.

12. Suspension & termination

You may stop using the service at any time. We may suspend or terminate access for breach of these Terms, non-payment, or to comply with law. On termination, your right to use the service ends and your data is handled per the Privacy Policy and your retention settings.

13. Governing law

These Terms are governed by the laws of New Zealand, and the courts of New Zealand have exclusive jurisdiction, unless your order states otherwise.

14. Changes

We may update these Terms; material changes will be reflected by the “last updated” date and, where appropriate, notified to customers. Continued use after a change means you accept it.
